Business names

Registration of a business name is obligatory and this should be arranged before use of a name commences. The mere registration of a business name does not provide any enforceable rights but registration gives de facto rights in the sense that third parties cannot register confusingly similar names.

The registration process

The registration system is not centralised and to obtain registrations Australia-wide, registration must be sought in each of the six Australian States and two Territories. The registration process is straightforward but the practice of the various registries is not uniform.
